The huge flaw in natural rights, is namely it supposes all humans will play and treat each other equally.
This is fundamentally untrue. Have you noticed the proponents of natural rights talk quite a bit about infringements on the same? Natural rights are a guide for humans to understand their boundaries and those of others. It is a philosophy built on the understanding that people try to take from and hurt other people; it explains who has what rights and which actions cause infringements on others' rights.
If you think what you wrote here, then you have fundamentally misunderstood natural rights up until now.
In theory, a north Korean has the same natural rights as a person here. Reality shows a vastly different outcome.
People in North Korea do indeed have the same rights. Why do you think it's near-universally acknowledged that North Koreans are oppressed? If their rights come from govt, then they are not oppressed. Their rights must come from somewhere else, something bigger than govt, for people to understand that they are being oppressed.
North Korea is Exhibit A for supporting the existence of natural rights.
Does one truly have rights, when they aren't respected?
Yes, of course! And in fact, natural rights are at their highest importance when determining that they are being disrespected.
