Computing the NY tax rate wasn't his fraudulent act

The "fraud" was in preparing - or causing to be prepared, W-2 that understated his income by over $100k/yr. He also caused fraudulent payroll tax returns (including SUTA - since it's NY) to be filed. Additionally, he also caused fraudulent Forms 1099 to be filed - characterizing some of his wages as non-employee compensation, so that he could claim deductions for KEOUGH plans that he was not eligible (allegedly).
The amount of tax that he underpaid was not the "fraud". The fraud was knowingly omitting the benefits (sounds like trumpco kept detailed records of the benefits and reconciled them to his arranged salary.) They're not smart criminals.
