I'm betting that if he hadn't allegedly been selling individual cigarettes, they would have found some other reason to hassle him.

The vast majority of individuals that enforce tax laws - be the federal, state, income, sales or property tax, are not armed (and don't use choke-holds.) You are more likely to be struck and killed by lightning, than in dealings with that personnel.
