in modern day dispute resolution regarding alleged rapes.

It's not a major departure from what can be done to assess whether a crime has occurred.

The brightlines create unwanted consequences. (a) You endorse actions above the line, and (b) You can penalize innocent consensual behavior where there is no victim.
