Why bother worrying about justification?
It never ceases to amaze me how folks like yourself are suddenly so consumed with Presidential Authority, the constitution, rule of law when for 8 years you were cheering for things like the ACA.
"but it was ruled constitutional" allowed you to smugly, and ignorantly convince yourself it wasn't a grotesque federal overreach, just because your team did it.
I don't know the law on the "border emergency" approach, but at least there is some questionable but logical rationale involved - enforcing US borders; what would that be for climate change, now that you're a constitutionalist?
