I am convinced of BDI, family covered it up. Sterling silver was out for Christmas- the spoon was also huge and an adult wouldn't have used an oversized sterling silver spoon to feed a kid a snack. In addition, the tea bag in the glass next to the pineapple only had Burke's fingerprints. Adults also don't put hot tea in a glass. Burke was having that snack alone. I'm not sure how jonbenet ended up there, however, somehow the kids ended up in the basement. The marks on her back and jawline were consistent with the train set in Burkes train room, also in the basement.
I believe the kids ended up in the basement- maybe under the pretense of opening secret gifts- and whether they had a fight or he tried to abuse her, he started to strangle her in the turtleneck she'd been put to bed in, which left a triangular shaped bruise on her neck, with knuckle marks. Sometime soon after, maybe when she broke free, he hit her over the head with a flashlight or golf club (found nearby), then was poking her hard with the train set when she wouldn't regain consciousness. it is also possible Burke had used the train set tracks (which is electric with hot ends) to hurt her before he hit her. I wouldn't be surprised if he'd done that before. I also suspect Burke had been abusing her for awhile. When JB either wouldn't wake up or screamed, that's when patsy came into play. She was probably still awake packing for their vacations. I think she assumed that Burkes strangeling her had killed JB, and not the skull fracture (the magnitude of which was probably unknown at that time, before her autopsy). She sent Burke to bed and deliberated her options. Clearly what she saw- however disturbing- was not shocking to her, and assumed that by calling 911, jonbenet wouldn't be revived, and she'd be sent to prison and/or Burke would be taken away from them. Otherwise, what motivation would she have to cover up the accident?
Having decided to make the accident look like a kidnapping, she changed JB out of the turtleneck she'd been in, staged the kidnapping and murder to cover up for the stragulation marks Burke had left, wiped her down, and wrote the ransom note.
patsy then called the police for two reasons: one reason is because they were supposed to be waking up to leave for their vacation home. She wanted it to look like she'd just woken up and found the note. Reason two why she called the police AND her friends and pastor over is because she wanted an audience to "witness" authorities- or someone other than a family member- "finding" Jb's body. Can you imagine how much worse it would have looked if the police had shown up to find the parents standing over a mauled body and staged crime scene?
Btw, Burkes voice could be heard in the background of the 911 call, even though he was supposed to be "asleep." He had hit her with a golf club before on milestone days- her birthday, his feces were found smeared on her Christmas gifts in her room, she had been sexually abused before, and he behaved very oddly in his interview two weeks after her death and with the most recent dr Phil interview.
I can't imagine the terrible situation and anguish the parents were in before and after the accident happened, though their dishonesty is sickening.
