By fault and action of another. It is the accident, that they caused,which in turn lead to property damage and physical injury.

However,despite the fact that you apparently won't answer what responsibility the at fault person has I will endeavor to answer yours.

They are made whole through uninsured motorist programs. Some are mandatory, others are not (but that is a different op) Than they would have the option to bring a suit. This option would go away under you scenario
