they are citizens of another country and hence not subject to the jurisdiction of the US.

This isn't "my" position. I'm just explaining the 14th.

the 14th doesn't address/isn't concerned with if the parents are in the US legally or illegally. It is concerned with their being subject to another country when the child is born.
