background report not investigation-the FBI has no jurisdiction over that event and given the time frame no other law enforcement as the statute of limitations has very likely ran. It is now part of the official record and something for Senators to reject/accept as they see fit.

If proven true at a later time it could possibly be grounds for impeachment under Article 3, that says justices can be impeached for other than criminal acts under the rather ambiguous term "good behavior"
