reporting that the attorneys for Kilmar Abrego Garcia are now asking to DELAY his "release" from custody in the criminal case until July 16.
Here's the deal -- this is going to be an integrity test for the Magistrate and District Judge in that case.
Their orders are not "shields" for KAG's attorneys to prevent his removal.
He made a motion saying there was no legal/factual basis for a detention order in his criminal case.
The Magistrate Judge agreed and issued an order that he be released on conditions of pretrial release.
That Order was affirmed by the District Judge.
That is it. Their work is done. They have applied the Bail Review Act to his case and found that the law does not provide for his detention.
There are no "collateral" issues in play simply because he is an illegal alien at risk for removal from the country.
It is an 8th Amendment violation to hold someone in custody where the facts and law do not justify it.
KAG is detained in the "care, custody, and control of the USMS." The USMS is part of DOJ and the Attorney General should direct the USMS to not violate the 8th Amendment."
