Most of the time, the "speedy trial" is delayed by motions from the defense. A defendant does have the right, and courts will usually push a trial forward with very few delays if it is only the prosecution making motions. This is one reason a prosecutor needs to be ready with all their evidence at the start of the trial. If on discovery it becomes evident that there is insufficient evidence, the defense will push forward quickly so as not to give the prosecution more time to obtain evidence.
