Courts will more likely than not rule that Trump exceeded his authority under IEEPA to enact the tariffs. The Administration will be hard pressed to convince a court that the US is facing an "unusual and extraordinary threat... to the national security, foreign policy, or economy of the United States" that originates "in whole or substantial part outside the United States."
