is falsifying business records. That's typically a misdemeanor. However, Bragg is trying to stretch it into a felony by breaking each individual payment to Cohen out separately while also claiming the falsifying of said business records was to cover up another crime. However, the underlying crime has not been specified yet in court. The prosecution hasn't even tried to prove the falsifying of business records was done with the intent to defraud somebody (which is an element of the crime).
