Threats and intimidation.
Assume there is no physical abuse, no rapes, no touching of any kind. Just two little Asian kids getting screamed at for being slant eyed freaks, yellow, devils, or little midgets.
Should these fourth graders just deal with it because it's freedom of speech from other fourth graders?
What if they're in junior high school… Or high school?
At what point does threatening speech become actionable?
And with all due respect, speech that is threatening or intimidating is not covered in the first amendment.
