Versus you example. This moves the OP from dealing with EOs to laws passed by the legislative body.

There are different mechanism for debating laws in legislation versus a single person dictating. Court challenges to laws are also different then challenging a short term EO that is over by the time the court starts to hear it.

So yes you moved the goal post
