you're paying him for his NIL (Name, Image, Likeness). The most difficult part of that is "Image" if you take it to mean more than just a picture. Why is he not playing? Has he done something to tarnish that Image so it's not as valuable to the payor? Think of a pro athlete with an endorsement contract. If they do something stupid, it could result in that contract being voided. At least that's the way I'd think about it.
