You fully defend that society has rights, and you really cannot even explain that. Who determines those rights? Why should people be punished, up to and including death by the state if they have harmed no one else.
You can say, this is what would be best for society, and we can discuss around that, but putting force behind it makes it very very different. And if you think governments have what is best for society in mind as they legislate, you are completely naive and blind.
