To some extent, there are laws that were put in place (described in article) that do give legal standing for it as well.

it is funny that the article correctly claimed that Trump used this many times as well.

But this is how government works...first you have to convince people there is a problem....then you don't even need a solution...just say you will work on one..but you need the power for it.
