Schools universally do not want the kids treated as employees. As employees they presumably be entitled to all employee benefit programs such as health care and retirement programs plus be entitled to the benefit of all employee grievance procedures, etc.
Theoritically, NIL payments are for use of the name, image or likeness of a player used to promote a business.
Arguably, the more successful the player is the better NIL he will have and the more effective he will be as a spokesman.
However, I would think tying his compensation to performance levels could be justified on the grounds it makes him a more effective spokesman, it would seem to clearly make the nil payments compensation for his athletic performance. Would think that would just be too much for NCAA to accept.
