"I can't breathe". He said that while he was in his cab, talking to the cop.

I am not an expert on drugs but if he had three (?) times the lethal dose of narcotics in his system, would he have died without being stopped by police?

Could he have survived if the cops had rushed him to the hospital?

But then he seemed to be resisting the cops.

I'll wait for more info, but it does not at this time, look like murder.
