If pubs push the nomination through and biden wins, and the dems win the senate the court will be packed.

If pubs don't push the nomination through and biden wins and the dems win the senate give it a 50/50 shot

If pubs win the senate the court will not be packed unless dems win the senate come midterm depending on what the pubs do with this nomination.

This nomination is a poison pill. Mitchell isn't the only one that can play games and we better believe games will be played if the nomination goes through.

Disclaimer: I do not believe the court should be packed, nor do I believe that this nomination should go through even though I will acknowledge it is perfectly legal and well within Trump and the Senate's right to do so.
