regardless. Georgia law doesn’t have degrees of murder unless a child’s death is involved then 2nd degree can be applied. Murder can be charged with or without malice being present, but lacking more information(excluding the video) than seen to date I could see a prosecutor decline to do so. That said, I cannot see how involuntary manslaughter wouldn’t apply. The defense of citizens arrest doesn’t apply as it is only recognized if an actual crime has been witnessed which doesn’t appear to be the case in this situation nor is self defense since the shooter brought the weapon to the scene.
In short, voluntary manslaughter should imo have been charged with or without the video.
