4Tigs, if a caregiver at my mom's nursing home has
sex with my mom and I find out, I'd raise the claim on her behalf that she was in no way capable of offering consent, just as you could argue if your 12 year old daughter agreed to have sex that she lacked the understanding to consent.
if you want to leave today thinking this is "denying someone's liberty with a subjective court", that's on you.
the reality is that not everyone IS capable of consent for reasons already shared, and this gives recourse for resolving infringements of the rights of those people.
