I think that depends upon the circumstances surrounding it. In this particular case I think there were major problems in doing so.
Getting FISA warrants to spy on US citizens should have a very high threshhold for probability of crimes having been committed or that are about to be committed. In this case the FBI violated their own rules in using unverified allegations to apply for such warrants and withheld critical information from the FISA court when they applied for it. It certainly appears that the did so because they knew that the court would have been more likely to turn down their request if they had told them the full truth. Withholding the truth is sub-optimal at best, no?
Added to that, the clear bias of some of the key investigators on this case (& Hillary's) is a cause for concern, no? The danger of having government spies spying on US citizens with the intent of thwarting the will of the voters is a HUGE risk in a democracy, no?
