market problem. If my ISP were throttling content I would simply switch to another provider who was not.

I know your counter argument will be many places only have single providers. Why is that? In most cases it is because municipalities have enforced monopolies on their residents. When I moved to my current location we had a single choice of providers and because of that we got high prices, bad service and very limited options. We now have at least five options and our price has been cut in half, our internet speeds have went up 50x and our channel options have exploded. None of these things happened until competition was introduced to the market.

Better service comes from competition NOT government regulation.
