less there than I originally thought. If president elects' we're not allowed to contact foreign governments until they were sworn into office and their people were all confirmed that would bring international affairs to a crashing halt for months every four years.

As long as the contacts were made after the election at the behest of the president elect then I think a defense lawyer could very easily make the case that they were acting in an official capacity.
