It is a simple economic problem. As long as the law provides minimal compensation for being bumped, the airlines will overbook.
My position is simple. The airlines should have to pay market price for the ticket they reclaim when they bump someone. How do you determine market price. You offer a price to the passengers on the plane over the PA system, if no one accepts you increase the offer until someone agrees to get off.
Yes this will increase ticket fares as reduced overbooking will result in an few more seats going empty because of no shows. But it is fair.
