Attempted arrest after a drug deal

Suspect hemmed in by police cars (but not hauled down and stopped short....Bill WIlkerson) and rams a car and brushes Stockley when he escapes. Pursuit. During the pursuit, officer says under his breath "I'm gonna kill that n*gger when I catch him". (Making the case for premeditation)
Catches said drug dealer. Approaches car and puts 5 rounds into drug dealer. Claims he had a gun.
Gun recovered only has Stockley's DNA on it.
Stockley is also sporting an AK-47 rifle/pistol conversion, against dept policy "for protection of his fellow officers".
Not an angel, but apparently not murder in the 1st degree.
