Yes, but I would guess he would waive his right to jury trial even with a black judge and with no ability to take a change of judge left. Not sure about the rules on taking a change of judge in criminal procedure, you have one time as a matter of right in civil procedure. But I think he'd take his chances with a black judge over a jury of his "peers" in the city of St. Louis.
However, it will certainly play into the narrative if the white judge finds the white cop (ex cop actually) not guilty.
