The issue for Mueller is how creditable is Comey. If the defense can effectively argue that Comey exaggerates and therefore can't be believed, then Mueller could easily lose.
A criminal verdict requires proof beyond a reasonable doubt, the highest standard of proof in the law. It requires a unanimous verdict. All it takes is one holdout for Mueller to lose.
Trial lawyer folklore holds that when a juror or jury become convinced that a witness is not telling the truth abut one thing, they believe nothing that witness says.
Since its a criminal case, a unanimous verdict and proof beyond a reasonable doubt are required for a conviction.
Consequently, Mueller's calculation is if the Defense can suggest Comey exaggerates, how likely am I to lose him as a witness and if I do, can I still win?
Nowhere in this discussion has Trump or his flamboyance been discussed. As I said, just how does Trump play into Mueller's calculation other than it was a chance for you to take a shot at Trump?
