i'm sure there's a lot of information that is not publicly available, but it appears as though the prosecutor is alleging the absence of evidence is itself evidence of premeditation.
public record indicates it isn't assigned to a judge yet and there is no signed arrest warrant, suggesting no judge thinks the probable cause statement is sufficient to execute an arrest warrant. this has every appearance of prosecutors doing prosecutor things. i bet they go to a grand jury to avoid the judge's discretion. if he makes bond on the child abuse charge things will get interesting.
