charged with rape and is scheduled to go to court on June 10.

The courts did something that as far as I know has never been done before by ruling that suspended him violated his civil rights, certainly Illinois wasn't going to argue against it as he was their best player.

He can still earn NIL money while riding the bench... see Arch Manning and thousands of other examples. If he is suspended he can't earn NIL money.
